Consultation Response on Law on Archival Activity

Recognizing the need for modern solutions in a rapidly changing digital world, North Macedonia has initiated the process of preparing a new Law on Archival Material and Archival Activity. The existing legislation, adopted nearly 13 years ago, no longer reflects the current practices and challenges of document management and archival work. Seizing the opportunity to contribute to this important reform, AmCham North Macedonia actively participated in the open consultation process.

As part of its commitment to promoting a functional and forward-looking legal framework, AmCham submitted a position paper with comments and recommendations. The proposals focus on regulating documentary centers, enabling the storage of public archival material in private centers, ensuring the authenticity of electronic documents, clarifying the obligations of private archival material holders, and introducing the possibility for private archival material to be transferred to foreign legal entities. These recommendations aim to support the creation of a modern, effective, and practical archival system.
